1. Acceptance of Terms

1.1 Your access to and use of bestlocalagents.co (“the Website”) and all Services referred to in Section 2 is subject exclusively to these Terms and Conditions. You will not use the Services for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the Services you are fully accepting the terms, conditions, and disclaimers contained in this notice. If you do not accept these Terms and Conditions you must immediately stop using the Services. As used herein, the terms “We” or “Us” refers to BestLocalAgents, its affiliated real estate professionals, referral partners, mortgage partners, and service providers.

1.2 We reserve the right to update or amend these Terms and Conditions at any time. Your continued use of the Services following any changes shall be deemed acceptance of such changes. It is your responsibility to check these Terms and Conditions regularly.

2. The Services

“Services” consist of the Website and any functions provided by, through, or in conjunction with the Website, including but not limited to real estate lead generation and matching services, agent referral services, mortgage referral services (where elected by the user), email communications, telephone messages, and text messages. Unless stated otherwise, the Services are for your personal and non-commercial use only.

Through the Services, BestLocalAgents connects you with licensed real estate agents via our referral partner network (including ReferralMate). During the intake process, you will be separately asked whether you wish to be connected with a mortgage professional. Only if you affirmatively elect to be connected will your information be shared with our mortgage referral partners, including CrossCountry Mortgage, LLC (“CCM”). BestLocalAgents is a lead generation and referral service only and does not directly provide real estate brokerage or mortgage lending services.

The Services are not for use by individuals under the age of 18. By using the Services, you represent that you are 18 years of age or older.

3. Express Written Consent and Communications

PLEASE READ THE FOLLOWING CAREFULLY. DO NOT USE THE WEBSITE OR SUBMIT YOUR CONTACT INFORMATION IF YOU DO NOT WISH TO COMPLY.

EXPRESS WRITTEN CONSENT — REAL ESTATE SERVICES. BY SUBMITTING YOUR CONTACT INFORMATION THROUGH THE WEBSITE, YOU ARE PROVIDING YOUR EXPRESS WRITTEN CONSENT TO RECEIVE COMMUNICATIONS FROM BESTLOCALAGENTS AND ITS AFFILIATED REAL ESTATE AGENTS AT ANY EMAIL ADDRESS OR TELEPHONE NUMBER YOU PROVIDE, EVEN IF YOU ARE REGISTERED ON A NATIONAL OR STATE DO-NOT-CALL LIST. THESE COMMUNICATIONS MAY INCLUDE TELEMARKETING MESSAGES DELIVERED VIA EMAIL, LANDLINE, FAX, CELLULAR PHONE, AND TEXT MESSAGES (INCLUDING SMS AND MMS).

EXPRESS WRITTEN CONSENT — MORTGAGE REFERRAL (OPT-IN ONLY). IF YOU AFFIRMATIVELY ANSWER YES TO THE QUESTION “DO YOU WANT TO BE CONNECTED WITH A LENDER?” DURING THE INTAKE PROCESS, YOU ARE SEPARATELY AND EXPRESSLY CONSENTING TO HAVE YOUR CONTACT AND TRANSACTION INFORMATION SHARED WITH OUR MORTGAGE REFERRAL PARTNERS, INCLUDING CCM, AND TO RECEIVE COMMUNICATIONS FROM THOSE PARTNERS REGARDING MORTGAGE AND LENDING SERVICES. IF YOU ANSWER NO, YOUR INFORMATION WILL NOT BE SHARED WITH ANY MORTGAGE PARTNER AND YOU WILL NOT BE CONTACTED BY ANY LENDER THROUGH OUR PLATFORM.

AUTODIALING. WE AND OUR PARTNERS (WHERE YOU HAVE OPTED IN) MAY USE AN AUTOMATIC TELEPHONE DIALING SYSTEM (“AUTO-DIALER”) WHICH MAY EMPLOY AN ARTIFICIAL OR PRE-RECORDED VOICE OR ROBOTEXTS. YOUR CARRIER'S STANDARD RATES AND CHARGES MAY APPLY.

NO PURCHASE NECESSARY. AGREEING TO THESE COMMUNICATIONS IS NOT A CONDITION OF PURCHASING ANY PROPERTY, GOODS, OR SERVICES.

You have the right to withdraw your consent at any time. You may opt-out of phone calls by contacting us via the methods listed in the “Contact” section of the Website; opt-out of emails by clicking the “unsubscribe” link in any email we send; and opt-out of text messages by replying STOP to any text message you receive from us.

4. Referral Fee Disclosure

BestLocalAgents operates as a referral service. When you are connected with a real estate agent through our platform, that agent pays BestLocalAgents a referral fee equal to twenty-five percent (25%) of the agent's gross commission upon the closing of your transaction. This fee is paid by the agent and does not increase your cost as a buyer or seller.

If you opt in to be connected with a mortgage professional through our platform (including CCM), BestLocalAgents may receive a referral fee from that lender upon the closing of your loan. This referral arrangement is disclosed in accordance with the Real Estate Settlement Procedures Act (RESPA) and applicable state law. Connection with a mortgage partner is entirely optional — you are under no obligation to use any mortgage partner and your decision does not affect the quality or availability of real estate agent referrals provided to you.

5. User Account, Password, and Security

In order to use certain features of the Services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.

6. Acceptable Use

6.1 You represent that any Content you submit is owned by you or you have sufficient rights to submit it, does not violate any intellectual property or privacy rights of any third party, and does not violate any applicable laws.

6.2 In using the Services you agree NOT to:

  • Post or transmit material that is defamatory, obscene, threatening, abusive, or unlawful
  • Threaten, abuse, stalk, or otherwise violate the legal rights of others
  • Upload files containing viruses, malware, or other harmful code
  • Misrepresent your identity or affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Services

6.3 We reserve the right, at our sole discretion, to remove any Content that violates these Terms and Conditions.

7. Third-Party Partners and Websites

The Services may refer you to third-party service providers, including licensed real estate agents and, where you have opted in, mortgage lenders. Any such referral is not an endorsement of those parties' services. Once you engage directly with a referred party, your relationship is governed by their separate terms and policies. We are not responsible for the actions or representations of referred third parties.

8. Termination

We reserve the right to suspend or terminate your access to the Services at any time without notice if we reasonably believe you have violated these Terms and Conditions.

9. Intellectual Property Rights

The Website, Services, and all content therein are protected by copyright, trademark, and other intellectual property laws. You may access and use content solely for personal, non-commercial use. No content may be reproduced, sold, or distributed without our prior written consent.

We do not claim ownership of content you submit. However, by submitting content you grant us a worldwide, royalty-free, non-exclusive license to use and display such content solely for the purpose of operating and improving the Services.

10. Disclaimers and Limitation of Liability

10.1 THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK.

10.2 BESTLOCALAGENTS DOES NOT GUARANTEE THE QUALITY OR SUITABILITY OF ANY REFERRED REAL ESTATE AGENT OR MORTGAGE LENDER. WE ARE A REFERRAL PLATFORM ONLY.

10.3 TO THE MAXIMUM EXTENT PERMITTED BY LAW, BESTLOCALAGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES.

10.4 Nothing in these Terms shall exclude liability for death or personal injury caused by our negligence.

11. Indemnification

You agree to indemnify, defend, and hold harmless BestLocalAgents, its officers, directors, employees, and partners from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your use of the Services.

12. Governing Law and Severability

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which BestLocalAgents maintains its principal place of business. If any provision is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
